These terms are governed by Dutch law. The legal entity is identified below.
1. The agreement
These terms govern your use of the Rijwind API and dashboard. By creating an account you accept them. If you don't accept them, don't create an account.
2. Plans, quota, and billing
Plans, monthly request limits, and prices are listed at rijwind.com/pricing. The plan you select is renewed automatically each month until you cancel. Billing is in EUR through Mollie; invoices are emailed and also available from your dashboard.
Each plan ships with a monthly request budget that resets on the first of each calendar month. Hard-cap plans return HTTP 429 once the budget is exhausted; soft-cap plans bill the overage on the next invoice. The exact behaviour is documented at docs.rijwind.com/quotas.
You can upgrade, downgrade, or cancel any subscription at any time from your billing page. Downgrades take effect at the end of the current billing period; you keep the higher plan's quota until then.
3. What we promise
- The API is available on a best-effort basis. We target 99.9% monthly uptime but do not offer a contractual SLA at the free or starter tiers. Custom SLAs are available on enterprise agreements — contact us.
- We give at least 12 months' notice before retiring an API version. v1 will remain functional until that notice is announced.
- Material changes to these terms or to pricing are announced at least 30 days in advance.
- All processing happens on EU-resident infrastructure. We do not transfer data to third countries.
4. What you promise
- You keep your API keys confidential and revoke them promptly if compromised.
- You configure an allowed-origins list on any browser-side key (see the docs).
- You don't use the API to harass, defraud, surveil individuals, or in any way that breaks applicable law in your or your end-users' jurisdictions.
- You don't attempt to circumvent quota or rate limits (e.g. by issuing keys from multiple accounts to share one workload).
- You don't redistribute the API responses as a stand-alone product (e.g. resell our geocoder without value-add). Embedding responses in your own product is fine — that's the point.
5. Suspension and termination
We can suspend or terminate an account that violates these terms, that has unpaid invoices more than 30 days overdue, or that is generating traffic patterns that materially threaten the service for other customers. We notify you by email before suspending unless the situation requires immediate action (e.g. credential leak, sustained abuse).
You can terminate your account at any time from settings. Outstanding invoices remain due; we delete all account data within 30 days of termination except records we are legally required to retain (typically tax records — 7 years in the Netherlands).
6. Intellectual property
You retain ownership of the queries and data you send through the API. We retain ownership of the API, the basemap, and the dashboard. We grant you a non-exclusive, non-transferable licence to use them as long as your account is in good standing.
7. Liability
To the maximum extent permitted by Dutch law, our aggregate liability for any claim is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages. This cap does not apply to wilful misconduct or gross negligence.
8. Governing law
These terms are governed by Dutch law. Disputes are submitted to the competent court in Amsterdam.
